As a third-country national who is a family member of an EU citizen, you can apply for a permanent residence permit for residence in the Czech Republic after 5 years of continuous residence in the territory of the Czech Republic or after 2 years of continuous residence in the country, provided that you have been a family member of a citizen of the Czech Republic or a family member of an EU citizen, who has been granted permanent residence in the Czech Republic, for at least 1 year.

You are a third-country national who is a family member of a citizen of the Czech Republic or a family member of a citizen of another EU Member State with permitted permanent residence in the Czech Republic.

Under these conditions, you can apply for a permanent residence permit as early as after 2 years of continuous residence in the Czech Republic, provided that you have been a family member of an EU citizen for at least 1 year, or after 5 years, regardless of how long you have been a family member of an EU citizen.

Or you can file an application for a permanent residence permit for a third-country national who is a family member of an EU citizen after 5 years of continuous temporary residence in the Czech Republic. With this application, it does not matter how long you have been a family member of an EU citizen.

An application for a permanent residence permit for a family member (a third-country national) of an EU citizen is to be filed exclusively in person on a duly filled out application form.

The forms are available on the Information Portal for Foreigners. 

If you have been a family member of an EU citizen for at least 1 year, enclose the following required documents with an application for a permanent residence permit after 2 years of continuous residence in the Czech Republic*:

  • a travel document (it is necessary to submit the original of the document);
  • a document confirming the fact that you are a family member of another citizen of the European Union;
  • a document confirming compliance with the condition of 2-year continuous temporary residence;
  • 2 photographs;
  • a proof of accommodation.

Enclose the following required documents with an application for a permanent residence permit after 5 years of continuous residence in the Czech Republic, during which you have been a family member of an EU citizen*:

  • a travel document (it is necessary to submit the original of the document);
  • a document confirming the fact that you are a family member of another citizen of the European Union;
  • a document confirming compliance with the condition of 5-year continuous temporary residence;
  • 2 photographs;
  • a proof of accommodation.

*The documents required to be enclosed with the application must not be older than 180 days, with the exception of the travel document, the vital records certificate and the applicant’s photograph, as long as it corresponds to their actual appearance. It is always necessary to submit the originals or officially authenticated copies of the documents. As for the travel document and the vital records documents to be submitted, their originals must be submitted.

The application, along with the appropriate documents, is to be filed at an office of the Department for Asylum and Migration Policy of the MOI (DAMP MOI). 

The most suitable office would be considered the office with territorial jurisdiction over the applicant’s registered place of residence.

It is always necessary to submit the originals or officially authenticated copies of the documents. The original of the travel document or the originals of the vital statistics documents will be returned to you after their copies are made on the spot.

Jaký má služba benefit

You will receive a permanent residence permit in the territory and your position will be in many respects similar to that of a Czech citizen. You will be issued a permanent residence permit, which is issued for a period of 10 years. The card can later be extended, also repeatedly.

Možnosti odvolání

You can appeal against the decision within 15 days of the delivery of the decision.

You can file the appeal in person or send it by mail (or electronically) to the given office of the MOI CR or to the head office of the MOI.
