Municipal waste, sorting and municipal system

According the Act No. 541/2020 Coll., on Waste (Waste Act) municipality is obliged to take over all of the municipal waste generated on its territory through the activities of citizens (natural persons not engaged in business).  

Municipality is also obliged to gather municipal waste separately. It must gather separately at least hazardous waste, paper, plastics, glass, metal, biological waste, edible oils and fats and, from January 1st 2025, also textiles.

According to Decree No. 273/2021 Coll., on the details of waste management, the municipality can carry out the separate gathering of municipal waste through collection yards, waste management facilities, large-volume containers, collection containers, the bagging collection method, or a combination of the methods.

Municipality must ensure separate gathering of biological waste at least of plant origin, paper, plastics, glass, metal and edible oils and fats throughout the whole year. Separate gathering of municipal hazardous waste must municipality carry out at least twice a year. For example, through mobile collection.

Each municipality then decides on the specific method of collection of both mixed municipal waste and sorted components of municipal waste. Municipality usually does so by means of a generally binding decree, in which it establishes the municipal waste management system and stipulates in it the conditions for the collection of municipal waste. Municipality determines the types of containers into which citizens hand over the given type of municipal waste, as well as the location of these containers in the municipality. Citizens are obliged to follow the generally binding decree.

In the generally binding decree the municipality may also set (but also does not have to) that it will take over from citizens construction and demolition waste generated on the territory of the municipality during the activities of citizens (as natural persons not engaged in business), movable things in order to prevent the production of waste (in the re-use regime), end-of-life products (electrical and electronic devices, fluorescent lamps and discharge lamps, batteries and accumulators and, last but not least, tires) and plant residues from the maintenance of greenery, gardens and households for processing into compost as part of community composting.

Furthermore the municipality may (but does not have to) set in the generally binding decree that it will take over municipal waste form entrepreneurs (legal entities and natural persons engaged in business). They then enter into a contract with the municipality and hand over their municipal waste to the municipal system, often for a fee determined by the municipality.

The most common way municipalities and cities collect municipal waste in the Czech Republic is by placing collection containers for mixed municipal waste directly next to citizen‘s properties (their houses), placing collection containers for sorted waste such as plastics, paper, glass and metals on the streets of the municipality or city and the rest of municipal waste can citizens drop off at the municipal collection yard.

Municipalities do not have to take over construction and demolition waste from its citizens as it is not municipal waste. But many municipalities do so and take over construction and demolition waste for a small fee in addition to a municipal waste fee. They also often set a limit on the amount of construction and demolition waste that citizens can hand over per person per year.

Citizens are then obliged to hand over municipal waste by type and on the locations designated by the municipality in line with the rules set by the generally binding decree of the municipality.

If citizens decide not to join the municipal system, they must be prepared to prove to the representatives of the municipality that they dispose of waste in a different way according to the Waste Act (for example, they hand it over to a waste company that is authorized to accept the waste, or directly to a waste recycling facility or to a landfill). In the case of municipal waste that he/she normally produces, and construction and demolition waste that he/she does not process itself, the citizen must have the handover of this waste in the appropriate amount secured by a written contract before the waste is produced.

The municipality becomes the owner of waste or movable thing at the moment when the citizen deposits it at the location designated by the municipality for that purpose. This means at the moment when the citizen places the waste in the appropriate collection container or, for example, at the collection yard, in the case of movable things that he/she hands over in the re-use mode, then at the moment when he/she places them at the re-use center or re-use point.

Everyone is obliged to dispose of waste or movable thing that they hand over to the municipal system at the locations designated by the municipality in accordance with the obligations established for the given type, category or material of waste by the Waste Act and by the generally binding decree of the municipality, if issued. If a citizen (as natural person not engaged in business) does not act in this way, he/she commits an offense for which he/she may be fined CZK 50,000.

The municipality is obliged to inform at least once a year in a way that allows remote access about the methods and extent of separate gathering of municipal waste, the recovery and disposal of municipal waste and about the possibilities of preventing and minimising the generation of municipal waste. At least once a year the municipality will publish, in a manner enabling remote access, quantified results of the municipality’s waste management, including the costs of operating the municipal system.
