A foreign (guest) insolvency practitioner is appointed if this is appropriate, justified and temporary.
The position of insolvency practitioner may be filled by what is known as a ‘guest’ insolvency practitioner.
The rotating assignment mechanism is not used to appoint a guest insolvency practitioner. A guest insolvency practitioner may be appointed by the president of the insolvency court, provided that this is a temporary or occasional appointment that is appropriate in view of the insolvency proceedings so far, the debtor, the debtor’s financial situation, and the professional competence of the guest insolvency practitioner who is to be appointed.
